Minor exemption request


Before you begin, make sure to prepare the required documents as listed in Section 3 of the form below. Your request will be reviewed by a member of the Urban Planning Department who will advise you of its admissibility or not. When a request is validated as complete, you will need to make the payment in order to register your file for the next Planning Advisory Committee (PAC) meeting, according to the rates in effect, thereby completing your application.

Justifications of the request according to the criteria of By-Law 1576 on minor exemptions

Have you considered all possible ways to make sure the project complies with the regulations?
Do you consider the request to be "minor" in terms of quantity (variance), environmental impact (integration into its natural environment and repercussions) and architectural impact (building characteristics and urban integration)?
Do you consider that the application of the regulatory provisions has the effect of causing you a "serious prejudice"?
Do you consider that the exception does not hinder the neighbors' enjoyment of their right to ownership (if applicable, notify neighbours of the upcoming work)?
Do you consider that the exemption will not have the exacerbate safety or public health risks, and that the exemption will not affect the quality of the environment or general wellbeing?

If you have answered ''No'' to any of the above questions, the application is not admissible.

Section 3: Required documents

The following documents must be provided to validate the admissibility of the request:

  • A power of attorney from the owner authorizing the applicant to act on his or her behalf (if required).
  • Title establishing that the property in question is owned by the applicant.
  • A certificate of location, a site plan, or a site planning of the existing property prepared by a land surveyor, as well as a plan clearly illustrating the elements covered by the application for a minor exemption.
  • Recent photographs of the property, as well as photographs to help understand the context of the adjacent buildings.
  • Any other plan or document required by the Urban Planning Department in order to understand the context of the application and assess whether the evaluation criteria of By-Law 1576 on minor exemptions have been met.
